Azerbaijan

The Republic of Azerbaijan, referring to paragraph 2 of Article 3 of the Convention,
declares that its application shall be subject to the conclusion of inter-state agreements
with the other Party concerned.
The Republic of Azerbaijan declares that it will be unable to guarantee compliance
with the provisions of the Convention in its territories occupied by the Republic
of Armenia until these territories are liberated from that occupation.
Cyprus

In accordance with Article 2, paragraph 2, of the Convention, the Republic of Cyprus
declares that the Convention shall apply exclusively to all local authorities, Municipalities
and Communities as defined, created and functioning respectively under the erstwhile
relevant Laws of the Republic of Cyprus, i.e. the Law on Municipalities and the Law
on Communities.

In accordance with Article 3, paragraph 5, of the Convention, the competent authority,
under the Law of the Republic of Cyprus, to exercise control or supervision with respect
to the local communities and authorities covered by the Outline Convention (as well
as for the implementation of the Convention and its Protocols), is the Minister of
Interior and any other person authorised by the Minister for this purpose.
The Ministry of Foreign Affairs would also like to reiterate its objection, as this
was submitted to the Council of Europe on 8 September 2011, related to the reservation
made by the Republic of Turkey on 11 July 2001, in its ratification instrument of
the Convention (ETS No. 106), limiting cooperation to local administrations of states
with which the latter has diplomatic relations.
Denmark

We approved, confirmed and ratified the said European Outline Convention on Transfrontier
Co-operation between Territorial Communities or Authorities with reservation subject
to the Faroe Islands and Greenland.

Finland

Finland, according to the Article 2, paragraph 2 of the European Outline Convention
on Tranfrontier Co-operation between Territorial Communities or Authorities, intends
to confine the scope of the Convention to municipalities and federations of municipalities
which are competent for the transfrontier co-operation in Finland.
Georgia

Georgia declares that, according to Article 3, paragraph 2, of the Convention within
the scope of this Convention, Georgia will conduct transfrontier co-operation through
the conclusion of inter-state agreements with other contracting Parties to this Convention.
Georgia declares that, until the restoration of territorial integrity of Georgia,
the Convention will not act on the territories of the Autonomous Republic of Abkazia
and the former Autonomous District of South Ossetia, where Georgia is unable to exercise
its full jurisdiction.
Hungary

The Republic of Hungary hereby announces that until the recall of the present declaration
the Hungarian authorities listed below are pronounced as those coming under the force
of the European Outline Convention on Transfrontier Co-operation between Territorial
Communities or Authorities on the basis of the Paragraph 2, Article 2 of the Convention,
in compliance with the decrees of the Hungarian Law:
a. the communal, urban, capital and its district and county self-governments;
b. the Metropolitan Public Administration Office or the County Public Administration
Office (*).

Italy

The Italian Government, referring to paragraph 2 of Article 3 of the Convention, declares
that its application shall be subject to the conclusion of inter-state agreements.
The Italian Government also confirms the following declaration, made at the time of
signature (on 21 May 1980) :
1. The authorities which, under the Italian legal system, may conclude the agreements
and arrangements covered by this Convention are : regions, provinces, municipalities,
mountain communities, municipal and provincial associations (consorzi) for the provision
of services and carrying out of works.
2. The Italian territorial authorities empowered to conclude the agreements and arrangements
covered by this Convention must, unless they are directly adjacent to a foreign State,
be situated within 25 km of the border.

In accordance with the provisions of Article 2, paragraph 2, of the Outline Convention,
the Principality of Monaco specifies that the scope of application of the Convention
is limited to the municipality of Monaco, Monaco's territory being one municipality
whose limits correspond to the State borders. The Principality intends to limit the
scope of application of the co-operation to the following object, within the competences
of the Town Council of Monaco : organisation of cultural, recreational, artistic and
leisure events.
In accordance with the provisions of Article 3, paragraph 5, of the Outline Convention,
the Principality of Monaco indicates that the authority competent to exercise control
in respect of the municipality of Monaco is the State Minister.
Romania

Romania states that the enforcement of the Outline Convention, mentioned in Article
1, is subordinated to concluding interstate agreements, and that the area of enforcing
the provisions related to the transfrontier co-operation is strictly limited to the
territory of the border counties.
In accordance with the provisions of Article 2, paragraph 2, of the Outline Convention,
Romania declares that the stipulations of the Outline Convention are to be applied
to communities and, respectively, territorial authorities designated to exercise regional
competences, which, according to the legislation in force, are counties, and county
councils, as well as to communities, and territorial authorities with competence in
the field of exercising local functions, which are, according to the legislation in
force, communes and towns, as well as their local councils from the border counties.
Serbia

The Republic of Serbia, in accordance with Article 3, paragraph 2, of the Convention,
declares that its application shall be subject to the previous conclusion of inter-state
agreements with other Party concerned.
Failing that, the effectiveness of transfrontier collaboration Agreements signed by
territorial authorities will require the express consent of the Governments of the
Parties concerned.
Slovakia

The Government of the Slovak Republic, referring to paragraph 2 of Article 3 of the
Convention, declares that its application shall be subject to the conclusion of inter-state
agreements.
Spain

The Kingdom of Spain, in accordance with Article 3, paragraph 2 of the Convention,
declares that its application shall be subject to the previous conclusion of inter-state
agreements with the other Party concerned.
Failing that, the effectiveness of transfrontier collaboration Agreements signed by

of the Parties concerned.
The Kingdom of Spain, in accordance with Article 3, paragraph 5 of the Convention,
specifies that the Authorities competent to exercise control or supervision with regard
to the territorial communities and authorities concerned are : the Ministry of Foreign
Affairs and the Ministry of Public Administrations.
Sweden

In accordance with the provisions of Article 2, paragraph 2 of the Convention, Sweden
intends to confine the scope of the Convention to the following authorities and bodies:

Türkiye

This Convention, taking effect with regard to the co-operation of local administrations
of States with whom Turkey has diplomatic relations, will be valid only for the special
provincial administrations, municipalities, villages and local authorities associations
that are founded with this purpose in Turkey.
Objection Cyprus, 18-12-2013
The Republic of Cyprus objects to the reservation in the instrument of ratification deposited by the Republic of Turkey on 11 July 2001, limiting cooperation to local administrations of States with which the Republic of Turkey has diplomatic relations. The aforesaid reservation is contrary to the object and purpose of the Convention as it precludes the realisation of the cooperation foreseen by the Convention between all Member States of the Council of Europe, one of which is the Republic of Cyprus, and, as such, the said reservation is invalid.
