Azerbaijan

The Republic of Azerbaijan declares that it is unable to guarantee the application of the provisions of the Convention in the territories occupied by the Republic of Armenia until these territories are liberated from that occupation (the schematic map of the occupied territories of the Republic of Azerbaijan is enclosed).

Georgia

Georgia declares that it will not be responsible for violations of the provisions of the Convention and the safety of the members of the European Committee for the Prevention of Torture and Inhuman and Degrading Treatment or Punishment on the territories of Abkhazia and the Tskhinval region until the territorial integrity of Georgia is restored and full and effective control over these territories is exercised by the legitimate authorities.

Italy

The Italian government declares that paragraph 2 (a) of the Annex on Privileges and Immunities should not be interpreted as excluding any police or customs check of the luggage of the members of the Committee, provided the check is carried out in compliance with the rules on confidentiality set forth in Article 11 of the Convention.
EXPLANATORY NOTE
In its explanatory report to the Senate of the Republic, dated 4 July 1988, on the ratification of the Convention, the Italian Government had indicated that "at the time of deposit of the instrument of ratification, [the Government] shall make a declaration of interpretation of paragraph 2 (a) of the Annex on Privileges and Immunities, under which the said paragraph 2 (a) should not be interpreted as excluding any police or customs check of the luggage of the members of the Committee, provided the check is carried out in compliance with the rules on confidentiality set forth in Article 11 of the Convention.
Due to an omission, the declaration was not made to the Secretary General, depository of the treaty, upon deposit of the instrument of ratification on 29 December 1988.
The Government of Italy corrects today this clerical mistake by forwarding to the Secretary General the text of the above mentioned declaration, to take effect at the date of entry into force of the Convention in respect of Italy.
