1. In the New OACPS-EU Partnership Agreement, including in the Africa Regional Protocol, the Federal Democratic Republic of Ethiopia understands any expression of the term "regional and international criminal justice mechanisms" only as a mechanism which it has ratified and expressly accepted. Furthermore, Article 19, sub-Article 3 of the New OACPS-EU Partnership Agreement should not be understood to imply the acceptance of the jurisdiction of the International Criminal Court by the Federal Democratic Republic of Ethiopia.
2. In the New OACPS-EU Partnership Agreement, including in the Africa Regional Protocol, the Federal Democratic Republic of Ethiopia understands any reference to the phrase "gender and gender equality" and "other status" in accordance with its Constitution and international agreements to which it is party to.
3. In the New OACPS-EU Partnership Agreement, including in the Africa Regional Protocol, the Federal Democratic Republic of Ethiopia understands reference to the term "sexual and reproductive health and rights" in accordance with its Constitution as the rights of women to access to education and information on family planning and the capacity to benefit thereby so as to protect their good health and prevent health hazards resulting from child birth.
4. For the Federal Democratic Republic of Ethiopia, the application of Article 74 the New OACPS-EU Partnership Agreement and Article 78 of the Africa Regional Protocol is limited to its international human rights obligations and its national laws regarding the protection of data, privacy and information of its nationals and permanent residents in Ethiopia.
5. The New OACPS-EU Partnership Agreement, including in the Africa Regional Protocol shall not derogate the obligation of States under international law in relation to refugees and migrants, including in relation to the provision of life-saving humanitarian assistance irrespective of their status and the principle of responsibility and burden-sharing with large refugee hosting countries. Furthermore, the protection and humanitarian assistance of internally displaced persons is primarily within the (domestic) prerogative of the country concerned.

The Government of the Co-operative Republic of Guyana declares its understanding that its signature to the Partnership Agreement between the European Union and its Member States, on one part and the Members of the Organisation of African, Caribbean and Pacific States, of the other part, (the Samoa Agreement) shall not be interpreted, in any manner whatsoever, as constituting its consent to be bound by the rules and principles of international refugee law, international law and international humanitarian law in relation to the recognition and rights of refugees set out in the provisions of the Samoa Agreement.

The Constitution of Jamaica entrenches and guarantees to every person in Jamaica the fundamental rights and freedoms to which they are entitled by virtue of their inherent dignity as persons and as citizens of a free and democratic society. The Constitution prescribes judicial processes to be observed in the event of the violation of any of these rights whether by the State or by a private individual. Neither Signature, Provisional Application nor Ratification of the Samoa Agreement by Jamaica implies the acceptance of obligations going beyond the constitutional limits.
The Agreement includes some terms which do not have a universally agreed definition, or whose usage is not agreed as amongst the Parties hereto. The Government of Jamaica therefore understands that the Samoa Agreement will be interpreted and implemented by Jamaica in a manner consistent with Jamaica's domestic legal and policy frameworks. Without limiting the generality of the foregoing, Jamaica understands that Article 29 (5) does not impose an obligation on Jamaica to legalise or decriminalise abortion. Further, the Government of Jamaica understands that, in relation to Jamaica, references to 'sexual and reproductive health' and 'family planning services' do not include a reference to abortion other than where the termination of a pregnancy is made lawful under its domestic law.
The Government of Jamaica also declares that it understands that the Samoa Agreement does not alter the interpretation of or create new legally-binding obligations under international law in respect of any other instrument, including any treaty, declaration or resolution. Without limiting the generality of the foregoing, the Government of Jamaica further declares that, while it is committed to the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP), it does not consider the last sentence of Article 9 of the Samoa Agreement as creating binding obligations as to the interpretation or implementation of the UNDRIP. In this regard, it is recalled that the UNDRIP is not a legally-binding instrument.

Maldives

The signature, provisional application, or ratification of the "Samoa Agreement" by the Republic of Maldives shall be without prejudice the Constitution of the Republic of Maldives and shall not go beyond constitutional limits. The "Samoa Agreement" will therefore be applied by the Republic of Maldives in a manner that is consistent with the domestic legal procedures and frameworks.
General Provisions
1. Article 1 (Objectives), Article 3 (Partnership Dialogue), Article 4 (Policy coherence), Article 79 (Cooperation in international organisations and forums)
The Government of Maldives interprets that the "Sarnoa Agreement" does not obligate signatories and parties to the Agreement to have common positions on issues irrespective of national interest and constitutional requirements. Instead these Articles are interpreted to facilitate dialogue for the formulation of common positions to the extent each signatory or party to the Agreement is able to within their national constitutions.
2. Article 9 (Human rights, democracy and rule of law)
The Constitution of the Republic of Maldives guarantees every individual in the Maldives the fundamental rights and freedoms to which they are entitled to. Therefore, the Government of Maldives will apply Article 9 without prejudice to the Constitution of the Republic of Maldives.
3. Article 19 (Serious crimes of concern to the international community)
The Government of Maldives maintains that the "Responsibility to Protect" does not have an internationally agreed definition nor a legal basis for the procedures on its application. The international community, through the United Nations, has the responsibility to use appropriate diplomatic, humanitarian and other peaceful means, in accordance with Chapters VI and VIll of the United Nations Charter, to help to protect populations from genocide, war crimes, ethnic cleansing and crimes against humanity.
4. Article 71 (Smuggling of migrants)
Although the Maldives is not a party to the Protocol against the Smuggling of Migrants by Land, Sea and Air of the UN Convention against Transnational Organized Crime, the Government of Maldives will take steps to strengthen legislative and institutional frameworks to prevent cross-border crime of migrant smuggling.
5. Article 76 (Refugees and other displaced persons)
The Government of Maldives is not a party to the Convention related to the status of refugees and the Protocol relating to the status of refugees and has taken note of calls to sign and ratify them. In order to effectively implement the provisions of this Article, the Government of Maldives would require substantial assistance.
6. Article 97 (Other agreements or arrangements)
The Government of Maldives understands that the provision in this Article will not be applied retrospectively — in line with the general principles of international law and in particular the Vienna Conventions on the Law of Treaties of 1969 and 1986.
7. Article 101 (Dispute settlement and fulfilment of obligations)
The Government of Maldives interprets that the 'appropriate measures" mentioned in the Article should be based on the principles of natural justice and fairness. The application of these measures must also be communicated to the other Party prior to their implementation.
Annex II
1. Article 1 (Legal personality and status)
The presence and operations of the European Investment Bank within the Maldives shall be subject to the constitution and laws of the Republic of Maldives in line with immunities and privileges accorded by the Government of Maldives. The treatment will be similar to other institutions of the same status.
2. Article 4 (Recognition of court decisions)
The Government of Maldives can only enforce sentences issued by courts outside the jurisdiction of the Maldives in line with the Act No. 32/2021 (Civil Procedure Act).”

General Part
1. Article 4 (Policy Coherence)
It is Namibia's understanding that the provisions of this Article mean that national policies are defined and based on the country's imperatives and legal requirements. Further considerations for Regional, Continental and Multilateral arrangements shall be taken into account to the extent in which they are not inconsistent with the Namibian Constitution and laws.
2. Article 1 (Objective); Article 3 (Partnership Dialogue); Article 4 (Policy Coherence); Article 79 (Cooperation in international organisations and forums)
It is Namibia's understanding that these Articles grant flexibility to the Parties and promote a dialogue through consultation to facilitate adoption of common positions at global stage. In the circumstances, therefore this Agreement does not create an obligation for the Parties to have common positions regardless of their national/constitutional requirements.
3. Article 9(2) (Human rights, democracy and rule of law)
Namibia's commitment is based on and within the context of the Constitution of the Republic of Namibia ("the Namibian Constitution") and in particular Chapter 3 contains clear and comprehensive provisions on human rights, including the prohibition of discrimination in any form and further includes the grounds upon which Parliament have and may enact legislations for advancement of persons within Namibia who have been politically, socially, economically or educationally disadvantaged by past discriminately laws or practices. This position is also consistent with various United Nations Conventions on Human Rights and on discrimination to which Namibia is a Party.
4. Article 19 (Serious crimes of concerns to the international community)
Article 19(1): The general principles set out herein are aligned with to the Charter of the United Nations and its related instruments, and consistent with the laws of Namibia. It is therefore Namibia's understanding that these principles (including the principle of responsibility to protect) shall be applied in a transparent and non-discriminatory manner and in accordance with the relevant United Nations legal frameworks.
Article 19(3): The commitment set out in this Sub-article is based on the understanding that the operations of these institutions are consistent, fair and just and are applied in accordance with the relevant statutes.
5. Article 36 (Gender equality and women and girls' empowerment)
Article 36(2): Namibia has been implementing and will continue to implement the outcome of the reviews of the Beijing Declaration and has been participating in the process of the Platform for Action and Programme of Action of the International Conference on population and Development to the extent that permitted by the Namibian Constitution and relevant legislation.
6. Article 49 (Trade and sustainable development)
Article 49(1): It is Namibia's understanding that this Sub-article shall not apply to policies and measures that are aimed at addressing the historical economic and other inequality, environmental protection, socio-economic development and transformation.
7. Article 51 (Trade in Services)
Article 51(2): It is Namibia's understanding that the commitments set out herein shall be aligned to and in terms of the commitments of Namibia with the WTO.
8. Article 97 (Other or arrangements)
It is Namibia's understanding that this provision shall not apply retrospectively, and it relates only to subsequent treaties, convention, agreements or arrangements of any kind. And this position is in line with the general principles of international law and in particular the Vienna Conventions on the Law of Treaties of 1969 and 1986.
9. Article 101 (Dispute settlement and fulfilment of obligations)
The "appropriate measures" envisaged in terms of this Article must be communicated to the other Party prior to their implementation. This approach and understanding is based on the principles of natural justice and fairness.
African Regional Protocol
10. Article 22 (Services)
Article 22(3): The Declaration relating to Article 51 (set out herein above) applies to this Sub-article.
11. Article 40 (Gender equality and empowerment of women)
Article 40(6): The Declaration relating to Article 36 (set out hereinbefore) applies to this Sub-article.
12. Article 49 (Wildlife)
Namibia wished to record that the EU acknowledged that the current text contains an error regarding the issue of the destruction of stockpile and therefore shall not be interpreted in terms of the current wording; and must subsequently be corrected through an amendment to the Agreement.
13. Article 51 (Climate action)
Article 51(3): It is Namibia's understanding that this provision does not in any way preclude/prohibit Namibia from introducing efficient fossil fuel subsidies. Namibia has already put in place various robust measures and legal frameworks to protect the environment and to ensure that the exploitation of natural resources is done sustainably and in a responsible manner and to minimise adverse impact on the people and the environment.

Article 1(1) read with Article 2 : The understanding of Namibia is that the presence/operation of the EIB within Namibia shall be subject to the relevant laws in Namibia and in accordance with the general practice and principles of international law.
Article 1(2) treatment shall be similar to that is accorded to institutions of the same status.
15. Article 3 (Foreign exchange)
This shall be done subject to Namibia's Exchange Control Regulations.

Trinidad and Tobago recognises that Article 6 of the General Part provides that the General Part, Annexes and the Regional Protocols shall be legally binding on the Parties, however, it is Trinidad and Tobago's understanding that this will be interpreted in the context that neither signature, provisional application nor ratification of the Samoa Agreement by Trinidad and Tobago implies the acceptance of obligations going beyond the limits provided by the Constitution of the Republic of Trinidad and Tobago of the following fundamental human rights and freedoms namely (a) the right of the individual to life, liberty, security of the person and enjoyment of property and the right not to be deprived thereof except by due process of law; (b) the right of the individual to equality before the law; (c) the right of the individual to respect for his private and family life; (d) the right of the individual to equality of treatment from any public authority in the exercise of any functions; (e) the right to join political parties and to express political views; (f) the right of a parent or guardian to provide a school of his own choice for the education of his child or ward; (g) freedom of movement; (h) freedom of conscience and religious belief and observance; (i) freedom of thought and expression; (j) freedom of association and assembly; and (k) freedom of the press.
2. Trinidad and Tobago understands that the Samoa Agreement will be interpreted and implemented by Trinidad and Tobago in a manner consistent with its domestic legal and policy frameworks.
3. Trinidad and Tobago also understands that Article 97 of the General Part provides that no treaty, convention, agreement or arrangement of any kind between one or more Member States of the EU and one or more OACPS Members, shall impede the implementation of this Agreement, however, Trinidad and Tobago understands this to mean that the Samoa Agreement is complementary to and does not supersede any treaty, convention, agreement or arrangement or other instruments of international law to which it is a party or signatory to. Further, any treaty, convention, agreement or arrangement or any other instruments of international law contained in the Samoa Agreement does not impose any obligation on Trinidad and Tobago to accede to or be bound by these instruments in which it is not a party or signatory to.
4. Trinidad and Tobago recognises that the Samoa Agreement includes some terms which do not have a universally agreed definition as amongst the Parties hereto. As such, Trinidad and Tobago understands that, in relation Article 29 (5) of the General Part and Article 48 (7) of the Caribbean Regional Protocol references to "sexual and reproductive health" and "family planning services" do not include a reference to abortion other than where the termination of a pregnancy is made under specific medical circumstances. Trinidad and Tobago further states that these Articles will be interpreted in accordance with the obligations imposed on it as a party to the Convention on the Rights of the Child, adopted on 20 November 1989 which recognises the Declaration of the Rights of the Child, which states that "the child, by reason of his physical and mental immaturity, needs special safeguards and care, including appropriate legal protection, before as well as after birth" and interprets the protection of the right to respect human life, as benefiting all persons from before birth. Trinidad and Tobago further states that no provision in the Samoa Agreement can impose an obligation on Trinidad and Tobago to legalise or decriminalise abortion.
5. So too, in relation to Article 48(7) of the Caribbean Regional Protocol, Trinidad and Tobago understands that references to "sexuality education" will be undertaken with full respect for the rights of parents and when applicable, legal guardians to ensure the religious and moral education of their children are in conformity with their own convictions and in accordance with laws of Trinidad and Tobago.
6. Trinidad and Tobago understands that any reference to the phrase "gender and gender equality" and "other status" will be interpreted in accordance with its Constitution and its laws.
7. Trinidad and Tobago declares its understanding that its signature, provisional application and ratification to the Samoa Agreement shall not be interpreted, in any manner whatsoever, as constituting its consent to be bound in relation to the recognition of rights of refugees and migrants set out in the provisions of the Samoa Agreement.
8. Trinidad and Tobago recognises that Article 9 (3) of the General Part of Samoa Agreement provides that "The Parties shall have partnership dialogue at bilateral level on the death penalty. Where the death penalty is provided for in national legislation and is still applied, the Parties shall adhere to due process and internationally agreed minimum standards" and that same will be interpretated in accordance with Trinidad and Tobago's domestic legal and policy frameworks. Further, Trinidad and Tobago declares that it is not a party to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and its Optional Protocol and the provisions in relation to this Convention as outlined in the Samoa Agreement will have no application in Trinidad and Tobago.
