1. Declaration of the European Union on the Scope of Application with regard to private actors pursuant to Article 3 paragraph 1 subparagraph b of the Convention
Recalling the obligation under Article 3 paragraph 1 subparagraph b of the Convention to address risks and impacts arising from activities within the lifecycle of artificial intelligence systems by private actors to the extent not covered in subparagraph a of that provision in a manner conforming with the object and purpose of the Convention, the Union declares that it will apply the principles and obligations set forth in Chapters II to VI of the Convention to activities of private actors placing on the market, making available and using artificial intelligence systems in the European Union through the implementation of Regulation (EU) 2024/1689 of the European Parliament and the Council of 13 June 2024 laying down harmonised rules on artificial intelligence and amending Regulations (EC) No 300/2008, (EU) No 167/2013, (EU) No 168/2013, (EU) 2018/858, (EU) 2018/1139 and (EU) 2019/2144 and Directives 2014/90/EU, (EU) 2016/797 and (EU) 2020/1828 (Artificial Intelligence Act). Other relevant Union acquis may also apply to these activities and contribute to the implementation of the principles and the obligations of the Convention.
2. Declaration of the European Union on the Territorial Scope of Application pursuant to Article 32 paragraph 1 of the Convention
Pursuant to Article 32 paragraph 1 of the Convention, the Union declares that, with regard to the competence of the Union, the Framework Convention on Artificial Intelligence and Human Rights, Democracy and the Rule of Law is to apply to the territories in which the EU Treaties are applied pursuant to Article 52 of the Treaty on European Union and under the conditions laid down in, inter alia, Article 355 of the Treaty on the Functioning of the European Union.

Norway

In accordance with Article 3, paragraph 1.b, of the Convention, the Kingdom of Norway declares that it shall apply the principles and obligations set forth in Chapters II to VI of this Convention to activities of private actors.

Ukraine

In accordance with Article 3, paragraph 1.b, of the Council of Europe Framework Convention on
Artificial Intelligence and Human Rights, Democracy and the Rule of Law, Ukraine declares that it shall
take other appropriate measures with respect to the activities of private entities not covered by Article 3,
paragraph 1, subparagraph “a”, of the Convention in order to fulfill the obligation set forth in Article 3,
paragraph 1, subparagraph “b”, of the Convention in a manner consistent with the object and purpose
of the Convention.
In accordance with Article 32, paragraph 1, of the Council of Europe Framework Convention on Artificial
Intelligence and Human Rights, Democracy and the Rule of Law, Ukraine declares that the Convention
shall not apply to the territory of Ukraine temporarily occupied by the Russian Federation until the
armed aggression of the Russian Federation against Ukraine is completely terminated, the territorial
integrity of Ukraine is restored within the internationally recognized state border of Ukraine, Ukraine
regains full control over the state border of Ukraine and the constitutional order is restored on the
relevant territory of Ukraine.
