governing the movement of persons, I have the honour to inform you that the name of
identity cards issued by Belgian posts abroad has been modified; in the Appendix to
the said Agreement, those cards are called: "Official identity and registration of
immatriculation card". Now the document is called: "Official identity card issued
to a Belgian national, having the force of an immatriculation certificate".
Moreover, I call your attention on the fact that those cards may be drafted in French,
Dutch or German.

Exact and complete denomination of the document appearing under "BELGIUM" in the Appendix
of the European Agreement on regulations governing the movement of persons between
Member States of the Council of Europe:
"Official identity card issued to a Belgian national, having the force of an immatriculation
certificate, by a Belgian diplomatic or consular agent abroad."
The list of document contained in the Appendix to the Agreement, regarding Belgium,
is therefore the following:
- Belgian passport, valid or expired within the last 5 years.
- Official identity card.
- Official identity card issued to a Belgian national, having the force of an immatriculation
certificate, by a Belgian diplomatic or consular agent abroad.
- Identity certificate with photograph issued by a Belgian Local Authority to a child
under 12 years of age.

- Valid alien's identity card, issued by the competent authorities of the country
of residence, for Belgians lawfully residing in France, Luxembourg and Switzerland,

The Kingdom of Belgium and Turkey are Parties to the European Agreement of 13 December
1957 on Regulations governing the Movement of Persons between Member States of the
Council of Europe.
In accordance with the provisions of Article 7, paragraph 1, of the European Agreement,
the Belgian Government is obliged to suspend with regard to Turkey the provisions
of Article 1, paragraphs 1 and 2, of the Agreement. Consequently, the Belgian Government
has decided to introduce an obligation for Turkish nationals to obtain a visa as from
1 November 1980. The Belgo-Turkish Agreement of 2 January 1956 on visas has also been
suspended.
28-04-1988
I have the honour to inform you that on 15 March last, the Ministry of the Interior
has decided to introduce a provisional identity card for Belgians. This identity document
will be delivered to Belgians who do not have a passport, who wish to travel to a
country where a passport is not required and whose new format identity card (in conformity
with Resolution (77)26 of the Council of Europe) had been lost or destroyed in the
days preceding the travel.
Consequently, this provisional identity card is to be considered as a travel document
in the sense of the European Agreement on Regulations Governing the Movement of Persons
between Member States of the Council of Europe, signed in Paris, on 13 December 1957.
The specifications and modalities governing the issue of this card have been published
in the "Moniteur belge" of 3 March 1988. A specimen of this card will be forwarded
shortly to the Member States of the Council of Europe by the Diplomatic Representation
of Belgium in the States concerned.

The Kingdom of Belgium and Ukraine are Contracting Parties to the European Agreement
on Regulations governing the Movement of Persons between Member States of the Council
of Europe of December 13th, 1957. The Kingdom of Belgium has however decided to suspend
temporarily the entry into force of the Agreement with regard to Ukraine, with immediate
effect, on the basis of Article 7 of the Agreement, if Ukraine ratifies this Agreement.
This step is deemed to be necessary on grounds relating to ordre public. Application
of this Agreement with regard to Ukraine is incompatible with Council Regulation (EC)
No. 539/2001 of March 15th, 2001, the Annex I of which stipulates that Ukraine is
one of those States whose nationals are bound by the obligation of visa when crossing
the Member States external borders.

In reply to the French notification JJ7792C Tr./025-61 dated 20 June 2014, the government
of the Kingdom of Belgium cannot agree with the proposed update of the list of documents
contained in the Appendix to the Agreement, pursuant to Article 1 (1) of the Agreement,
in its present form. The Kingdom of Belgium is concerned that the proposed formulation
might be misunderstood.
While Decree No. 2013-1188 quite clearly only extends the validity of documents in
circulation on 1 January 2014 with an additional 5 years, without mention on the document
itself, the proposed text might be misunderstood to mean that all French identity
cards would remain valid for an additional five years after the date of expiry as
it is not unambiguously clear that the words "these cards" only refer to cards issued
between 2 January 2004 and 31 December 2013.
In addition, the Belgian authorities would be grateful if the French authorities could
clarify whether the national identity cards delivered to minors remain valid for the
full 10 years even when the age of majority is reached earlier, or whether this hypothesis
cannot occur in reality.
Furthermore, the Belgian authorities are grateful to the Secretariat General to suspend
the term of tacit approval of this amendment until these questions have been resolved.
Cyprus

In compliance with the provisions of Article 7, paragraph 1, of the European Agreement,
the Government of the Republic of Cyprus shall, on grounds relating to "public order",
delay until further notice the entry into force of this Agreement in respect of Turkey.
In compliance with the provisions of Article 11, of the European Agreement, the Government
of the Republic of Cyprus declares that the list of documents mentioned in Article
1, paragraph 1 are :
- valid passport of the Republic of Cyprus,
- valid national identity card,
- valid laissez-passer.

The Federal Republic of Germany and Turkey are parties to the European Agreement of
13 December 1957 on Regulations governing the Movement of Persons between Member States
of the Council of Europe. By a Declaration, Turkey has suspended application of this
Agreement in accordance with Article 7 thereof.
However, the Federal Republic of Germany has the honour of notifying the Council of
Europe Secretariat of the following:
The Federal Republic of Germany has decided to introduce a general obligation for
Turkish nationals to obtain a visa as from 5 October 1980.
The 1953 Germano-Turkish agreement on visas has been terminated.
This step was considered necessary for reasons of "ordre public". The number of Turkish
nationals crossing the frontier of the Federal Republic of Germany with the intention
of circumventing residence and domicile regulations by abusing the right to asylum
increased extremely sharply in the first few months of 1980. Closer supervision of
entry into the territory of the Federal Republic of Germany is therefore essential.
After a period of three years the Federal Republic of Germany will reconsider whether
it is still necessary to make visas compulsory for Turkish nationals.

of 13 December 1957 on Regulations governing the Movement of Persons between Member
States of the Council of Europe, I have the honour to inform you that, on grounds
relating to "ordre public", the French Government is obliged to suspend with regard
to Turkey the provisions of Article 1, paragraphs 1 and 2, of the Agreement.
The obligation to hold a visa is therefore re-established for Turkish nationals going
to France for short visits. This measure shall enter into force on 5 October 1980.
12-12-1988
Following the perpetration of acts of terrorism in Paris in Autumn 1986, the French
Government was obliged in September 1986, in a decision of which the Secretariat General
of the Council of Europe was notified on 16 September 1986, to suspend application
of the European Agreement on Regulations governing the Movement of Persons between
Member States of the Council of Europe of 13 December 1957, in accordance with the
provisions of Article 7 of that Agreement. Subsequent developments and tighter co-operation
in Europe on security and anti-terrorist measures have prompted the French Government
to rescind the above-mentioned suspensive measure, with effect from 00.00 hours on
9 December.
This measure applies to nationals of Austria, Cyprus, Iceland, Malta, Norway, Sweden
and Finland, but it does not modify the provisions of which the Representative of
France informed the Secretariat General of the Council of Europe on 24 September 1980.

Position of the French Government concerning the altered list of documents appended
to the European Agreement on Regulations governing the Movement of Persons between
Member States of the Council of Europe (ETS 25), submitted by the Kingdom of the Netherlands
(notification No. JJ3299 C Tr./25-11 of 15 December 1994).
In application of Article 11 of this Agreement, the French authorities approve the
inclusion within its scope of the following types of travel document:
- national passport
- business passport
- diplomatic passport
- official passport (passeport de service)
- refugee's travel document
- European identity card
- laissez-passer.
The French authorities cannot agree to the alien's travel document being covered by
this Agreement. In fact, the Agreement states in its Article 5 that "Each Contracting
Party shall allow the holder of any of the documents mentioned in the list drawn up
by it and embodied in the Appendix to this Agreement to re-enter its territory without
formality even if his nationality is under dispute". The alien's travel document flagrantly
contradicts this provision in stating on its back cover that it "is valid for (re)admission
to the Netherlands only if the bearer is in possession of a valid authorisation to
stay or settle or of a provisional authorisation to stay in the Netherlands".
Before taking a final decision, the Government has initiated a procedure of bilateral
consultation with the Netherlands.

The Permanent Representation of France has the honour to notify the Secretariat of
the Council of Europe, in application of Article 11 of the European Agreement on Regulations
governing the Movement of Persons of 13 December 1957 (ETS No. 25), that a provisional
identity card has been issued by the French authorities. This card, valid for three
months, has been established to respond to an urgent need, whilst waiting for the
deliverance of a plastic identity card the production of which necessitates a further
delay.
The French authorities ask that this identity document be recognised as a valid identity
and travel document to allow access by French citizens to the territory of all States
Parties.

In reply to the notification n( JJ3382C Tr./25-13 of 18 May 1995, the French Government
cannot agree that the "laisser-passer" issued by the Dutch authorities shall be included
in the Appendix to the European Agreement on Regulations governing the Movement of
Persons between Member States of the Council of Europe (ETS No. 25) in its present
form.
In effect, this document, or at least one of its variants with a blue cover, may be
issued in the Netherlands to foreign nationals, which may pose a problem of (re)admission
of some bearers to the Netherlands. In consequence, France could accept this "laisser-passer"
only if it were issued by Dutch diplomatic or consular offices to its own nationals
deprived of any travel document - in the event of loss or theft - to permit them to
return to the Netherlands.

The Permanent Representation of France to the Council of Europe presents its compliments
to the Secretariat General and, in reply to the corrigendum to the Secretariat's notification
dated 13 August 1997 concerning the modification of the Appendix to the European Agreement
on Regulations governing the Movement of Persons between Member States of the Council
of Europe (ETS No. 25) requested by the government of the Federal Republic of Germany,
has the honour to inform that the French authorities reiterate their request to obtain
information about the main characteristics of the "provisional identity card", its
period of validity and the reasons for putting it into circulation.
There are some translation difficulties: the titles of travel documents issued, for
example by the Land of Berlin, have probably been inadequately translated into French
("carte d'identité provisoire et attestation de photo d'identité d'enfant"). The title
in German of these documents and their present conditions of validity should be specified.
In addition, it would be desirable to know whether a child with a "child's travel
certificate" of the FRG, valid or expired within the last year, may leave the country
without any other documentary evidence, or whether such a child must also be provided
with a parental permission to leave the territory.
Furthermore, the French authorities renew their request to receive two samples of
all the travel documents issued by the German authorities. They are grateful to the
Secretariat to maintain the suspension of the term of tacit approval of the amendments.

The Permanent Representation of France is pleased to inform the Secretariat of the
Council of Europe, in connection with the European Agreement on Regulations Governing
the Movement of Persons Between Member States of the Council of Europe (ETS no.25),
that a new standard passport was brought into circulation on an experimental basis
on 28 April 1999 by the Prefecture of Montpellier. The experiment will be extended
in May to the Prefecture of Dijon and the Paris Prefecture de Police.
The passport takes the form of a booklet of dimensions 125 mm x 88 mm. The burgundy-coloured
cover, made of soft synthetic material, is inscribed with the national coat of arms
in the centre, the words "Union européenne/République française" (European Union/Republic
of France) at the top and "passeport" (passport) at the bottom. It has 36 pages, numbered
from 1 to 36 inclusive. The personal particulars and photograph of the bearer appear
on page 2, which is printed in landscape format (sideways), with a 23 mm-high bar
code at the bottom. The document is valid for 5 years and is not renewable.
The French authorities have stated that the old passport design is still valid. It
will continue to be issued by Prefectures which do not have the special equipment
needed to produce the new passport, by the French High Commissioners in the overseas
territories and by embassies and consulates abroad.

In accordance with Article 11 of the Agreement, the Government of France updates the
list of documents contained in the Appendix to the Agreement, pursuant to Article
1 (1) of the Agreement, as follows:
- National passport of the French Republic, valid or expired within the last five
years;
- Valid French identity card.
Since 1 January 2014, pursuant to Decree No. 2013-1188 dated 18 December 2013, the
secured national identity cards (plasticised format) issued to adults are valid 15
years, as attested by the validity period indicated on these documents. Furthermore,
the duration of validity of the secured national identity cards issued to adults between
2 January 2004 and 31 December 2013 shall automatically be extended for five years,
even if no material alteration of the plasticised card attests of this. This extension
of the duration of validity without material alteration relates only to secured national
identity cards issued to adults between 2 January 2004 and 31 December 2013; national
identity cards issued as from 1 January 2014 have an expiry date of 15 years inscribed
on the document.
The validity of the national identity cards delivered to minors remains of 10 years
even if they reach the age of majority during this period of 10 years. The 10-years
validity period results from the minor status at the moment of issuance of the document.
Griekenland

I have the honour to inform you that by a decision of 15th April 1959, pursuant to
the provisions of the European Agreement on the Movement of Persons between Member
States of the Council of Europe, my Government grants, as from that date, the right
freely to enter and stay in Greece for a period of three months to nationals of the
following countries: Austria, Belgium, France, Federal Republic of Germany, Italy
and Luxembourg.
Nationals of these countries should possess the documents referred to in paragraph
1 of Article 1 of which a list is attached to this letter, in accordance with Article
11 of the above-mentioned Agreement.

Bezwaar Griekenland, 25-03-2002
Following the recent ratification by the Republic of Slovenia of the European Agreement on Regulations governing the Movement of Persons between the Member States of the Council of Europe (ETS 25), which entered into force for Slovenia on 1 January 2002, the Government of Greece, in exercising its right provided for by Article 11 of the above stated Agreement, does not accept the use of Identity Cards by the citizens of the Republic of Slovenia as valid travel documents, so that the latter could enter the external borders of the Schengen countries, because this measure, if accepted, would contradict the Schengen acquis (Common Manual, Part II, 2.1.).

In accordance with Article 11 of the Agreement, the Government of Greece has decided
to amend the list of documents mentioned in Article 1, paragraph 1, of the Agreement,
as follows:
-Valid Greek Passport,
-Personal Identity Card,
thereby replacing the term "touristic identity card" with the term "personal identity
card".
The Hellenic Republic and Ukraine are Parties to the European Agreement of 13th December,
1957 on Regulations governing the Movement of Persons between Member States of the
Council of Europe. Following its declaration dated 2nd May, 1959, the Greek Government
declares that it has decided, in accordance with Article 7 of the Agreement, to suspend
temporarily the entry into force of the Agreement in relation to Ukraine, should Ukraine
ratify this Agreement.
This step is deemed to be necessary on grounds relating to ordre public. Application
of the Agreement with regard to Ukraine is incompatible with Council Regulation (EC)
No. 539/2001 of 15th March, 2001, the Annex I of which stipulates that Ukraine is
one of those States whose nationals are bound by the obligation of visa when crossing
the Member States' external borders.

In accordance with the provisions of Article 11 of the Agreement, the Greek authorities
up-date as follows the list of documents, valid for the Greek citizens, appearing
in the Appendix to the Agreement:
- valid "new type" Greek passports (regular passports, diplomatic passports, official
passports), issued since 1 January 2006. Since 26 August 2006 , those passports include
biometric data (photo, personal data) contained in a RF-Chip, while since 26 August
2009 they include, additionally, images of fingerprints of the passport bearer, contained
in a chip.
- "new type" Greek Police Identification Cards (morphotype ID1), which are valid as
travel documents since 1 June 2010.
Hongarije

In accordance with Article 7 of the Agreement, Hungary, on grounds relating to public
order (ordre public), shall delay the entry into force of the Agreement with respect
of Turkey and Ukraine. Application of the Agreement with regards to the above-mentioned
States in incompatible with Council Regulation (EC) No.539/2001 of 15 March 2001 listing
the third countries whose nationals must be in possession of visas when crossing the
external borders and those whose nationals are exempt from that requirement, the Annex
1 of which stipulates that Turkey and Ukraine are among those States whose nationals
must be in possession of visas when crossing the external borders of the Member States
of the European Union.
In accordance with Article 11 of the Agreement, Hungary declares that the list of
documents of Hungary pursuant to Article 1 (1) of the Agreement is the following:
- valid ordinary passport or expired within one year,
- valid temporary ordinary passport,
- valid diplomatic passport,
- valid service passport for foreign service,
- valid service passport,
- valid shipman's service passport,
- valid identity card or expired within one year.
Italië

The world "Territory" means, for Italy: "The national metropolitan territory".

On 15 September 1962, the Italian Government revoked the decision of temporary suspension
of the Agreement between Italy and Austria, dated 28 December 1955, on consular visas.
As a consequence from the same date, the competent Italian authorities will apply
again the provisions of the European Agreement on regulations governing the movement
of persons between member States of the Council of Europe, signed on 13 December 1957,
to Austrian Nationals.

Following a communication from the Italian Ministry for Foreign Affairs, I have the honour to notify you that, in pursuance of Decree No. 851 of the President of the Republic dated 18 July 1967, published in the Official Journal No. 245 of 30 September 1967, the personal identity card issued to civil or military State officials, whether they are permanent or not, in service or on retirement, will be a valid document to go abroad, to member States of the EEC and to States with which special international Agreements governing the recognition of the identity card as a valid document to go abroad are in force.

The Grand Duchy of Luxembourg and Ukraine are Parties to the European Agreement on Regulations governing the Movement of Persons between Member States of the Council of Europe of December 13th, 1957 (ETS No. 25). The Grand Duchy of Luxembourg has decided, on the basis of Article 7 of the Agreement, to suspend temporarily the application of the Agreement with regard to Ukraine. This step is deemed to be necessary on grounds relating to ordre public and to public security. Application of the Agreement with regard to Ukraine is against the Council Regulation UE 539/2001 of March 15th, 2001, concerning visas. Annex I of the said Regulation stipulates that Ukraine is one of those countries whose nationals must be in possession of a visa when crossing the European Union external borders.

the list of documents contained in the Appendix to the Agreement, pursuant to Article
1 (1) of the Agreement, as follows:
- Identity card for persons aged of less than 15 years,

- Residence permit (Schengen).
Malta

The Kingdom of the Netherlands and Turkey are Parties to the European Agreement of
13 December 1957 on Regulations governing the Movement of Persons between Member States
of the Council of Europe.
In accordance with the provisions of Article 7, paragraph 1 of the European Agreement,
the Netherlands Government is obliged to suspend with regard to Turkey the provisions
of Article 1, paragraphs 1 and 2 of the Agreement.
Consequently, the Netherlands Government has decided to introduce a general obligation
for Turkish nationals to obtain a visa as from 1 November 1980.
The 1953 Neerlando-Turkish agreement on visas has been suspended. The number of Turkish
nationals crossing the frontiers of the Netherlands and of the other Benelux countries
with the intention of circumventing residence and domicile regulations by abusing
the right to asylum has increased sharply in recent years. Closer supervision of entry
into the territory of the Benelux countries is therefore essential.

With reference to my letter of 31 October, in which I informed you that the Netherlands
had raised objections to the second travel document listed by Turkey, I wish to inform
you that the Netherlands no longer maintains its objection to this travel certificate
(for only one trip to return to Turkey).
The Netherlands Government still holds the view nevertheless that the travel certificate
(for only one trip to return to Turkey) cannot be regarded as a travel document within
the meaning of Article 11 of the European Agreement on Regulations governing the Movement
of Persons, but the Netherlands has no objection to the use of such a document to
achieve the desired aim, that is as a kind of "laissez-passer".

The Ministry for Foreign Affairs of the Netherlands introduces the following new travel
documents which will be delivered as of 1 October 2001:
- national passport
- Dutch identity card
- business passport
- diplomatic passport
- official passport
- laissez-passer
- provisional passport
- refugee’s passport
- alien’s passport.
The present Dutch travel documents will not be delivered anymore as of 1 October 2001,
but will remain valid until their expiration date.
The Ministry for Foreign Affairs communicates, in the name of the Ministry of the
Interior and Kingdom Relations, that the Dutch law on passports will be modified with
effect from 1 October 2001 as follows : the European identity Dutch card (EIK) will
be changed to a Dutch identity card. The functions of this identity card remain unchanged.
Bezwaar Zwitserland, 19-12-2001
By notification of amendment of Appendix, dated 26 October 2001 and sent under reference
JJ5004C Tr. 25-26, the Secretariat transmitted to the States Parties to the Agreement
a declaration contained in a Note verbale, dated 21 September 2001, from the Ministry
for Foreign Affairs of the Netherlands.
Pursuant to Article 11 of the Agreement, and within the two months delay provided
by this provision, the Swiss authorities approve the inclusion, in the scope of application
of this treaty, of the following Dutch documents:
national passport,
Dutch identity card,
business passport,
diplomatic passport,
official passport,
laissez-passer,
provisional passport.
On the other hand, the Swiss authorities can not accept that the refugee's passport
and the alien's passport, listed also in the above-mentioned declaration, be covered
by this convention. Indeed, so far as the holders of these documents are not nationals
of one of the Contracting Parties, the facilities relating to the entry in the territory
of the other Parties provided by the Agreement do not apply to them (see Article 1,
paragraph 1, of the Agreement).
Moreover, the Agreement stipulates, in its Article 5, that "(e)ach Contracting Party
shall allow the holder of any of the documents mentioned in the list drawn up by it
and embodied in the appendix to this Agreement to re-enter its territory without formality
even if his nationality is under dispute". However, there is no information enabling
to consider the refugee's passport and the alien's passport as being also valid documents
for re-entering the Netherlands without condition and without formality.
As a consequence, Switzerland objects to the considered modification of the Appendix
in so far as it concerns the refugee's passport and the alien's passport.

The Kingdom of the Netherlands and Ukraine are Contracting Parties to the European

decided, if Ukraine ratifies this Agreement to suspend temporarily the entry into
force of the Agreement with regard to Ukraine, with immediate effect, on the basis
of Article 7 of the Agreement.
This step is deemed to be necessary on public policy grounds. Application of the Agreement
with regard to Ukraine is incompatible with Council Regulation (EC) No. 539/2001 of
March 15th, 2001 concerning visas, the Annex I of which stipulates that Ukraine is
one of those States whose nationals must be in possession of visas when crossing the
external borders of the European Union.
Bezwaar Frankrijk, 18-07-1995
In reply to the notification n(JJ3382C Tr./25-13 of 18 May 1995, the French Government
cannot agree that the "laisser-passer" issued by the Dutch authorities shall be included
in the Appendix to the European Agreement on Regulations governing the Movement of
Persons between Member States of the Council of Europe (ETS No. 25) in its present
form.
In effect, this document, or at least one of its variants with a blue cover, may be
issued in the Netherlands to foreign nationals, which may pose a problem of (re)admission
of some bearers to the Netherlands. In consequence, France could accept this "laisser-passer"
only if it were issued by Dutch diplomatic or consular offices to its own nationals
deprived of any travel document - in the event of loss or theft - to permit them to
return to the Netherlands.

On 21 September 2001 the Ministry of Foreign Affairs deposited, with reference to
Article 11 of the Agreement, with the Council of Europe a Declaration containing a
list of Dutch travel documents which would be issued as of 1 October 2001. This Declaration
was registered on 1 October 2001 by the Secretariat General of the Council of Europe.
One of the Dutch travel documents falling under Article 1, paragraph 1, of the Agreement
and included in the list registered in accordance with Article 11 of the Agreement
on 1 October 2001, is the “Dutch identity card”.
On 1 March 2017 the Dutch law on passports will be modified. Upon modification a “Substitute
Identity Card” will be introduced with the words “NOT VALID FOR TRAVEL!” at the front
and “NOT VALID FOR TRAVEL OUTSIDE SCHENGEN AREA” at the back.
The Kingdom of the Netherlands, on behalf of the European part of the Netherlands,
declares that the “Substitute Identity Card” will not be considered as a “Dutch identity
card” as registered in accordance with Article 11 of the Agreement and falling under
Article 1, paragraph 1, of the Agreement.
Oekraïne

In compliance with Article 11 of the Agreement, the Government of Ukraine declares
that the list of documents mentioned in Article 1, paragraph 1, are:
- the passport of citizen of Ukraine for travel abroad
- the diplomatic passport
- the service passport
- the child travel document
- the seaman's identity document (subject to provision of shipboard list or abstract
of it)
- the certificate of aircraft crew member (subject to provision of record in flight
list)
- the identity document for the return to Ukraine (only for the return to Ukraine).

Ukraine declares that, in accordance with paragraph 4 of Article 1 of the Agreement,
the term territory means the territory to which Ukraine applies jurisdiction in accordance
with its national law.
Ukraine declares that, in accordance with part two of Article 7 of the Agreement,
it will suspend the application of this Agreement to Parties to the Agreement which
apply part one of Article 7 of the Agreement with respect to Ukraine.

I have the honour to inform you that the Austrian Government wishes, in pursuance of Article 11 paragraph 2 of the European Agreement on Regulations governing the Movement of Persons, to withdraw from the list the child's travel certificate, a document which no longer exists in Austria.

With reference to the letter dated 14 December 1998 relating to the amendment of the Appendix - ETS 25 Declaration from Portugal - the Government of Austria makes an objection concerning the certificate of birth, if it is used by minors. The certificate of birth is not sufficient for the incontestable identification of the minor who holds it. Furthermore, minors must carry an identity card or be accompanied by an adult carrying a passport on which the minor appears.

The Federal President declares, on behalf of the Republic of Austria that the provisional suspension of the application in respect of Turkey of the Agreement of 13 December 1957 on Regulations governing the Movement of Persons between member States of the Council of Europe, according to Article 7 of the said Agreement, is extended with effect from 17 April 1990.

of my Government the following amendment to the list of documents referred to in Article
1, paragraph 1, of the said Agreement:
- Valid passport or expired within the last five years.
- Valid national identity card.
- Valid collective identity and travel certificate.
- Certificate of birth, if it is used by minors.

of Europe. The Portuguese Republic has decided, on the basis of Article 7 of this

regard to Ukraine.

this Agreement with regard to Ukraine is incompatible with Council Regulation EC No.
539/2001, the Annex I of which stipulates that Ukraine is one of those States whose

The Portugese Government has decided to revoke the declaration contained in a letter from the Permanent Representative, dated 18 June 1991, suspending the application of the European Agreement of 13 December 1957 on Regulations governing the Movement of Persons between the Member States of the Council of Europe with regard to Turkey. The revocation of this declaration does not affect the obligations to which Portugal is legally bound under the European Union and Schengen acquis.

The Federal Republic of Germany herewith raises an objection under Article 11 of the
European Agreement of 13 December 1957 on Regulations Governing the Movement of Persons
between Member States of the Council of Europe - ETS No. 25 - to the documents designated
by the Republic of Slovenia on deposit of its instrument of ratification of the Agreement
to be listed in the Appendix thereto pursuant to Article 1 of the Agreement.
The group passport and the identity card designated by the Republic of Slovenia in
the list of documents cannot be recognized for the purposes of crossing borders since
they do not meet the requirements laid down in Article 5, paragraph 1.a, of the Convention
Implementing the Schengen Agreement in conjunction with the Common Manual of the Schengen
partners.

With reference to the notification of ratification by the Republic of Slovenia of
the European Agreement on Regulations governing the Movement of Persons between Member
States of the Council of Europe of 13 December 1957, to which was appended the document
by which the Republic of Slovenia, pursuant to Article 11 of the said Agreement, included
a declaration with the list of travel documents, and concerning these travel documents,
the Government of Spain, in accordance with the said Article 11, raises objections
to the following travel documents:
With regard to the identity card, the Government of Spain can not accept it as it
is in contradiction with community law to the extent that it prevents the affixing
of a stamp confirming border crossing , therefore making it impossible to determine
the effective maximum duration of allowed stay.
With regard to the emergency passport, the Government of Spain can allow border crossing
only in case of departure from the Schengen zone, as it is equivalent to a laissez-passer
but can not be considered as a document accrediting the entry and the departure.
Finally, with regard to the group passport, the Government of Spain can only accept
the document known as "young persons collective passport" which corresponds to the
European Agreement on Travel by Young Persons on Collective Passports between the
Member Countries of the Council of Europe, done in Paris on 16 December 1961, since
the Common Consular Instruction, drawn up for the application of the Schengen Agreement
regime on visas, refers only to this document.
Bezwaar Luxemburg, 22-03-2002
In the declaration appended to the notification of its ratification of the European
Agreement on Regulations governing the Movement of Persons between Member States of
the Council of Europe, Slovenia confirmed the list of Slovene travel documents which
should enable the Slovene citizens to enter and travel on the territory of the other
States Parties. On 18 March 2002, the States members of Benelux have decided to raise
an objection concerning two of the documents mentioned in this list, which are:
- the Slovene valid identity card,
- the valid emergency passport.
Concerning this last document, the objection does not apply where the document is
used in order to transit the countries of the Benelux with a view to returning in
Slovenia.

Following the recent ratification by the Republic of Slovenia of the European Agreement on Regulations governing the Movement of Persons between the Member States of the Council of Europe (ETS 25), which entered into force for Slovenia on 1 January 2002, the Government of Greece, in exercising its right provided for by Article 11 of the above stated Agreement, does not accept the use of Identity Cards by the citizens of the Republic of Slovenia as valid travel documents, so that the latter could enter the external borders of the Schengen countries, because this measure, if accepted, would contradict the Schengen acquis (Common Manual, Part II, 2.1.).

of this treaty, of the following Slovene travel documents:

On the other hand, the Belgian authorities can not accept that the valid identity
card and the valid emergency passport be covered by this Agreement. Nevertheless,
the later document could be accepted in order to leave the territory of the Benelux
countries with a view to returning in Slovenia.
Accordingly, Belgium objects to the list mentioned in the Slovene declaration insofar
as it concerns the valid identity card and valid emergency passeport.

With reference to the notification of ratification by the Republic of Slovenia of
the European Agreement on Regulations governing the Movement of Persons between Member
States of the Council of Europe of 13 December 1957, to which was appended the document
by which the Republic of Slovenia, pursuant to Article 11 of the said Agreement, included
a declaration with the list of travel documents, and, concerning these travel documents,
with reference to the objection raised by the Government of Spain to the emergency
passport, the Government of Spain accepts the emergency passport issued by the Slovene
authorities provided that it is issued for the departure from the Spanish national
territory. In this case only, this document may be added to the list of travel documents
of the Appendix to the Agreement.

c) For persons under 18 years of age, valid national identity card together with an
authorisation given by the person exercising parental authority after appearing before
a central police station, magistrate, notary, mayor or commanding officer of a station
of the Civil Guard (Garde Civile).
As regards Spain, the term "territory" shall mean "the national territory".

The Kingdom of Spain and Ukraine are contracting Parties to the European Agreement
on Regulations governing the Movement of Persons between Member States of the Council
of Europe, signed in Paris on 13 December 1957. The Kingdom of Spain, basing upon
Article 7 of such Agreement, has decided to suspend, temporarily and immediately,
its implementation with regard to Ukraine.
Such a measure has been considered necessary for reasons referred to public order.
The application of the Agreement to Ukraine is contrary to the Regulation EC No. 539/2001,
which concerns the issuing of visas : its annex I stipulates that Ukraine appears
within the group of third countries whose citizens must have a visa to be enabled
to cross the external borders of the European Union.
Turkije

For reasons of security, the Turkish Government reserves its right to deny entry to nationals of Contracting Parties bearing one of the documents listed in the Appendix to the Agreement where such nationals do not arrive in Turkey directly from a member country of the Council of Europe.

Following my letter dated 30 May 1961, I have the honour to inform you that the European
Agreement on regulations governing the movement of persons between member States of
the Council of Europe, having been published on 1 December 1961 in the official Gazette,
entered into force on the same day according to the new Turkish constitution.
I take this opportunity, with reference to Declaration No. 1 made on 25 May 1961 at
the time of signature of the Agreement, to ask you to add the frontier post of Aydin
to those listed in paragraph b.

Turkey has found itself obliged to suspend the European Agreement of 13 December 1957 on Regulations governing the Movement of Persons between Member States of the Council of Europe in respect of Portugal, with effect as from 1 August 1991, in accordance with the principle of reciprocity and of Article 7.2 of the said Agreement.

Turkey has decided to withdraw the declaration contained in a letter dated 3 December
1991, regarding the suspension of the European Agreement of 13 December 1957 on Regulations
governing the Movement of Persons between Member States of the Council of Europe in
respect of Portugal, with effect as from 1 August 1991. On the other hand, Turkey
reserves the right of reciprocity on visa exemptions.
Zwitserland
21-03-1966
On 1 March 1966 the Swiss federal council decided to add in the list of documents
mentioned in paragraph 1 of Article 1 of the said Agreement the valid Swiss identity
card issued by a local authority. Consequently the list as far as Switzerland is concerned
reads as follows:
- Swiss Passport, valid or expired within the last five years;
- Valid Swiss identity card issued by a cantonal or local authority;
- For children under 15 years of age who have no passport or identity card, a laissez-passer
issued by the cantonal authority.

I have the honour to inform you that during today's session, the Swiss Federal Council
decided to reintroduce visa obligations into its relations with Turkey with effect
from 15 July 1982, except for holders of diplomatic, service or special passports,
Turkish nationals resident in Switzerland by virtue of a valid residence permit, Turkish
aircrews and young Turks travelling on collective passports in accordance with the
European Agreement on Travel by Young Persons.
In accordance with Article 7.1 of the European Agreement of 13 December 1957 on Regulations
governing the Movement of Persons between Member States of the Council of Europe,
the Federal Council has decided, on grounds relating to "ordre public", temporarily
to suspend, from 15 July 1982, the provisions of Article 1.1 and 1.2 of the said Agreement
in respect of Turkey.
Under the Agreement of 6 November 1963 between Switzerland and the Principality of
Liechtenstein on immigration regulations applicable to nationals of third party States
in the Principality of Liechtenstein and co-operation in the immigration field, the
decisions taken by the Federal Council also apply to Turkish nationals in the Principality
of Liechtenstein.
